Privacy Policy

Purpose
This Privacy Policy (“Policy”) applies to the AgencyIgnite website and web applications (collectively, the “Platform”) operated by AgencyIgnite, LLC (“AgencyIgnite”, “we”, “us”, or “our”). This Policy explains what personal information (“Personal Information” or “PI”) and non-personally identifiable information (“Anonymous Information” or “AI”) we collect, how we use it, and your rights regarding that information. This Platform is intended only for individuals who are physically located in the United States (excluding residents of the State of California) and is not intended for or directed to individuals located in any other country or jurisdiction, including the European Union, the United Kingdom, or any other jurisdiction with comprehensive data protection laws similar to the GDPR. If you are located outside the United States or are a re
sident of California, you must not access or use the Platform.

Acceptance
By accessing or using the Platform or by creating an account, you acknowledge that you have read, understood, and agree to this Policy and that you (a) are physically located in the United States, (b) are not a resident of California, and (c) are not located in the European Union, the United Kingdom, or any other non‑U.S. jurisdiction.

Policy Updates
We may update this Policy periodically. If material changes occur, we will notify you via email or through a notice on the Platform. Continued use of the Platform after updates constitutes acceptance of the new Policy.

Information We Collect
We collect:

  • Payment or billing information via secure third-party processors.
  • Communications and usage data related to the Platform.
  • Phone number(s) and SMS/text messaging consent records, including opt-in date, time, source, and message frequency preferences, where you have elected to receive text message communications from or through the Services.

How We Use Personal Information

We use Personal Information to:

  • Communicate updates, respond to inquiries, and send administrative messages.
  • Comply with legal obligations, enforce our terms, and enhance security.
  • Provide marketing materials (with opt-out options).
  • We may use aggregated or de-identified data for analytics, product improvement, and performance monitoring.
  • To send you transactional or informational text messages where you have provided your phone number and opted in to receive such communications. Message frequency may vary. Message and data rates may apply. You may opt out at any time by replying STOP. Reply HELP for help. We do not share or sell your phone number to third parties for their own marketing purposes.

 

Legal Basis for Processing (GDPR/CCPA)
Any references in this Policy to legal bases or rights under laws such as the GDPR or CCPA are provided for informational purposes only. The Platform is not intended for, and should not be used by, (i) residents of California, (ii) individuals in the European Union, the United Kingdom, or (iii) individuals located in any jurisdiction outside the United States. If you nevertheless use the Platform from such jurisdictions, you do so at your own initiative, and we do not undertake to comply with those laws except to the extent we are expressly required to do so.

Security
We implement reasonable administrative, technical, and physical measures to protect your PI from unauthorized access, alteration, or disclosure. Despite these measures, no system is fully secure. You are responsible for maintaining the confidentiality of your login credentials.

Anonymous Data and Tracking
We may collect AI such as IP address, device type, browser, and activity logs via cookies and analytics tools. You may disable cookies; however, some features may not function properly.

Third-Party Service Providers
We may share information with vendors performing services (hosting, payments, analytics, messaging). All third parties are contractually required to protect your information. We do not sell PI.

Links to Other Sites
Our Platform may link to external websites. We are not responsible for their privacy practices, content, or security.

Data Transfers
If AgencyIgnite undergoes a merger, acquisition, or reorganization, your information may be transferred as a business asset, subject to this Policy.

Data Retention
We retain PI as long as your account is active or as required to comply with law, resolve disputes, and enforce our agreements.

User Rights
Subject to applicable U.S. law (and only to users eligible to use the Platform under Section 1), you may request access, correction, or deletion of your PI, or request that we limit certain uses of your PI, where such rights are provided by applicable law. Submit requests using the contact details in Section 17. We may need to verify your identity before responding.

Children’s Privacy
We do not knowingly collect PI from individuals under 13. If we learn we have done so, we will delete such data promptly.

Cookies and Do Not Track
We use cookies and similar technologies as described in our Cookie Policy (Section 18). We currently do not respond to DNT browser signals.

Jurisdiction
This Policy and any dispute arising out of or relating to it or the Platform are governed by the laws of the State of North Carolina, U.S.A., without regard to its conflict-of-laws principles. We do not represent that this Policy complies with privacy or data protection laws outside the United States, and the Platform is not intended for use in any non‑U.S. jurisdiction, including California, the European Union, and the United Kingdom.
